RE: ATTORNEY DAVID J. PHILLIPS -- FILING OF COMPLAINT AND REQUEST FOR INVESTIGATION

Dear Sir or Ma'am:

I am requesting your office to initiate an investigation into the actions of Attorney David J. Phillips in representing John Gregory Lambros. There-fore, this is a formal filing of a complaint.

On November 28, 1995, I filed a Declaratory Judgement, copy attached that I would like returned, with the U.S. Clerk of the Court in Kansas City, Kansas, JOHN GREGORY LAMBROS vs. DAVID J. PHILLIPS, 95-3502-GTV, so the court could make a decision as to standards of effective assistance/legal duty Phillips rendered in the representation of John G. Lambros during U.S. Parole Commission proceedings.

Please note on page 12 that Margie A. Meehan, employee of the Missouri Supreme Court as an Administrative Secretary and Bar enrollment clerk for the Supreme Court, offered an Affidavit on October 23, 1995, stating that the records of the Missouri Supreme Court reflect that David J. Phillips is not listed on the roll of attorneys, is not licensed to practice law in the State of Missouri and not a member of the Missouri Bar. Attorney Phillips represented me at the United States Parole Commission, North Central Regional Office, Kansas City, MISSOURI. Please note that Attorney Phillips has been representing inmates at U.S.P. Leavenworth for years at the U.S. Parole Commission in MISSOURI in violation of State of Kansas, Code of Professional Responsibility DR 3-101(B) "A lawyer shall not practice law in a jurisdiction where to do so would be in violation of regulations of the profession in that jurisdiction" . Also in violation of the MODEL RULES OF PROFESSIONAL CONDUCT of the State of Kansas Rule 5.5 Unauthorized Practice of Law (a) & (b) and Rule 8.5 JURISDICTION "If their (lawyer) activity in another jurisdiction is substantial and CONTINUOUS, it may constitute practice of law in that jurisdiction". See e.g. Rule 5.5.

The Declaratory Judgement contains a plethora of issues that I think merit your investigation as to the actions of Attorney David J. Phillips in the representation of John G. Lambros.
